Assuming that torturing is a crime against humanity and using relevant sources of international law, explain where the torturers of Anwar Al Ibrahimi could be tried and under what legal basis. Critically analyze the possibility and practicality of such assumption of jurisdiction.
Anwar AL Ibrahimi was a victim of the Rendition program employed by the CIA for the prosecution and interrogation of Al’Qaeda terrorist organization, reinforced after 9/11 attacks. Often presented as the ultimate tool to capture terrorists, this practice has yet better known as “torture by proxy” where suspects are send to states where laws do not prohibit the use of oppression or physical abuse in the interrogation of a suspect.
The abduction and torture of Anwar is a crime against humanity on international law, which has universal jurisdiction, the aim of this essay is to explain onto which basis the torturers of Anwar al Ibrahimi will be prosecuted, and the difficulties that he will encounter in the process of prosecution, which will ultimately materialize the disparities between international law and morals, against state sovereignty effective planning.
