To have a functioning civilization you would have to have some form of a legal system. This can be as simplistic as an individual magistracy, or as complex as a full judicial system comprise of a judge, jury and lawyer. Under any of these scenarios lawyers have played a major role in representing the public in the legal system. A lawyer can act as an advisor, advocate or as a prosecutor.
The role of a lawyer is to instruct their clients about their rights, and what their obligation is to their client. The aspects of a lawyer’s job depend on the field in which the lawyer chooses to practices. A lawyer has a professional code of ethics that they must adhere to and it consist of three separate but mutual parts Canons, Ethical Considerations, and Disciplinary rules. Cannons are statements that general explain the relationship expected of lawyers to the public, and the legal system as well as the professional conduct expected of them as well.
Ethical Consideration is guiding principles in which a lawyer should strive, and rely on in unique situations. The public may need legal services but some people may not know how to seek legal service. Individuals that know the importance of seeking legal assistance are aware of their legal problem. The only way to make the public aware of the different legal services available to them is through advertising. Individuals with limited means rely on advertising to find an appropriate lawyer. An important function of the legal profession is to educate people to recognize their problem and to help the individual in choosing the right lawyer for their problem. Advertising is an important way for a lawyer to attract clients, and inform the public of their services.
Disciplinary rules are mandatory because they inform the lawyer the least level of conduct in which they cannot fall below without getting disciplinary action against them. A lawyer cannot violate the disciplinary rule or engage in illegal conduct that...
