This exercise is described as this: “John is an employee in a private sector organization. He wants to file a discrimination complaint against his employer.”(University of Phoenix, 2008) Since we only have that information, I will make assumptions based on the purpose of this paper.
John is an African American man that works for a private sector company. He feels that there are many Caucasian people who use racial slurs and hang posters that depict racial hate. John has feels that the Human Resources department is not doing anything to remedy the situation so he has decided to file a lawsuit against the company.
According to the Equal Employment Opportunity Commission website, John will need to follow certain steps before his case will go to court. John will first need to gather information necessary for his case. First he will need to get a list of names of the employees that are involved in the racial slurs and posters. John will also need to get the name and address of his employer including a corporate headquarters if necessary. He will also need to document the different incidents that occurred. If he possibly kept a journal during the time he felt the harassment he should include that. If he has the dates of the incidents, he will need to record that also.
John will also need to file this lawsuit within 180 days of the last violation. John will need to file his lawsuit with the Equal Employment Opportunity Commission also known as the EEOC. The EEOC will then assign the case a priority investigation. If the EEOC feels the accusations are justified they will send John a Notice of Right to Sue. John can then go to the court and file a lawsuit. This must be done within 90 days.
If the plaintiff or the respondent does not like the ruling on the case after it has gone to court, that individual may appeal the decision and take it to the next level. This can continue thru to the Supreme Court.
