Metro-East Company Accused of Race Discrimination

Issue: U. S. Equal Employement Opportunity Commission filed a lawsuit Monday in federal court against a packaging and warehousing company in Washington Park. The suit alleges Material Resources LLC., failed to provide an African-American employee with the pay raise and health insurance coverage provided to his white co-workers and alleged that he was fired because he filed a racial discrimination charge with the EEOC and accused the company of race discrimination. The issue is whether Material Resources racially discriminated against an African-American employee in compensation?
Rule: In George Yancey’s book, Beyond Racial Gridlock, he says, “If racism in history was all we had to deal with, it would be enough to create enormous barriers between majority group members and racial minorities. However, racism is not limited to overt personal bias or the effects of historic events. Racism is also manifested in the way we shape our current institutions.”
Application: We are trying to decide whether Material Resources racially discriminated against an African-American employee. In a statement by James Neely, director of the EEOC’s St. Louis District office, he says, “Employees cannot be denied benefits or pay increases because of race, and an employer cannot lawfully discharge an employee because he came forward with good faith claim of race discrimination.” Yancey also talks about corporate repentance, “Its goal is that European Americans will be grieved to realize that they benefit from racism even thought they are not racist themselves, and they will seek to understand more of the plight of people of color because they want to end the pain of racism.”
