The court in my opinion should not here the case. 13-8 The two parties should have discussed the location that the truck was to be towed. The fact that the labor charges were not discussed is no indication that they should not be paid. If the driver did not want his truck towed to that location he should have hade his intentions known. The contract is not unconscionable in my opinon because the truck had to towed somewhere. 13-9 The covenant should be enforced because Forsee agreed to the terms in advance and should be held acounable for his actions and not take the job for the time period he agreed to.
